The offer and sale of products through the website www.santeustachioilcaffe.com and orders sent and handled through the e-mail address info@santeustachioilcaffe.it are governed by the following General Terms and Conditions of Sale, formulated in accordance with the legislation on contracts concluded outside business premises and in particular with the provisions of Legislative Decree. Of September 6, 2005, no. 206 (Consumer Code).

By placing an order in the manner provided, the Customer declares that he/she has read all the information provided during the purchase procedure and fully accepts the General Conditions of Sale in force at the time of placing an order.

Products sold on the Site and any samples or giveaways that may be offered by Sant’Eustachio il Caffè Srl are for personal use only. The sale or resale of any products or promotional samples received is strictly prohibited.

Sant’Eustachio il Caffè Srl reserves the right, with or without notice, to terminate the supply of products if, in its sole discretion, it has reason to believe that your conduct may be in violation of these Terms of Use.

Orders, shipments and deliveries

Upon receipt of an order, Sant’Eustachio il Caffè Srl will automatically send a confirmation of receipt by e-mail, in which all the details of an order itself will be summarized.
Upon receipt of an order Sant’Eustachio il Caffè Srl will verify the availability of the ordered product and only upon such verification will it communicate its acceptance of an order. In the event that Sant’Eustachio il Caffè Srl is unable to process an order received it will promptly notify the Customer to the email address provided by the customer.
Any right of the customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance of an order is excluded.

Pursuant to these Conditions, payment must be made in advance using the payment methods specified in the following paragraph (Paragraph 7) .
Sant’ Eustachio il caffè will consider valid only those orders for which it will receive payment reserves the right to refuse orders from certain countries, due to the excessive onerousness of shipping or for other reasons to be understood in any case to be unquestionable.
After payment is made, each user will receive confirmation of the order on the email indicated for the request. Sant’ Eustachio il caffè undertakes to process each order within two working days from the time of receipt of payment. In the event that it is not possible to process the order within two days Sant’Eustachio il Caffè Srl will be required to notify the customer by email to the address provided. If payment is received during a period when the courier does not provide service (religious holidays or weekends), shipment will be made on the first available day. The user will receive the tracking number to check the status of the shipment on the carrier’s website.
The consignee of the goods is responsible for the payment of the taxes and customs charges prescribed by the regulations in force in the territory of destination of the products. From the moment of shipment, Sant’Eustachio Il Caffè Srl is not responsible for late delivery of products as the responsibility passes to the courier.

Deliveries, even within Italy, can take up to 7 working days due to courier delays or logistical disruptions. Price supplements may be required for fast premium service deliveries due to the different actual cost of delivery.

Right of withdrawal
Any damage to the packaging and/or the product or the mismatch of the number of packages or indications must be immediately contested by making specific indication on the delivery document. By signing the courier’s document, the Customer attests to the actual exterior integrity of the product and the conformity of the delivery.

Any problems concerning the actual physical integrity, correspondence or completeness of the products received must be reported within 14 working days of delivery by sending a notice to the e-mail address info@santeustachioilcaffe.it.

In execution of the provisions of Legislative Decree. February 21, 2014, No. 21 implementing Directive 2011/83/EU on consumer rights, the Customer may return the purchased product and obtain a refund of the purchase sum actually paid. The right of withdrawal can be exercised within the period of 14 days after receipt of the product in the following ways: It is possible to return only products purchased on the official website (www.santeustachioilcaffe.it) intact of which you have retained the box, packaging and all components. Any refund will be made as soon as possible and in any case within 14 (fourteen) days from the date on which the customer has exercised her right of withdrawal and through the same method of payment used by the customer: Payments Saferpay paying with Visa /Mastercard circuits or bank transfer with the bank details that the customer will be required to communicate. In the event that the customer had paid by credit card, the refund will be made by bank transfer and the customer will be required to provide the bank details.

In the event that the value of the products has suffered a decrease caused by handling other than that necessary to establish the nature, characteristics and functioning of the products, (by way of example: damaged products, not regularly or completely packaged, or in which certain parts are missing or have been damaged, such as components, elements, accessories, packaging materials, boxes, documentation and/or other objects), Sant’Eustachio Il Caffè will refund the Customer the purchase sum minus the value of said decrease.

In the event that the Customer sends back products after the above deadline or in the case of products that have been opened and/or partially used and are not suitable to be returned, the right of withdrawal does not apply and Sant’Eustachio Il Caffè will return the purchased goods to the Customer, charging him/her the shipping costs.

Exclusion of the right of withdrawal
Pursuant to and in accordance with Art. 59 of the Consumer Code, Sant’Eustachio Il Caffè S.r.l. reserves the right to refuse the return and deny a refund of the price of all so-called perishable goods, which, once received by the customer, cannot be subject to withdrawal. Products subject to the application of this article include, but are not limited to, ground coffee in tins, ground coffee in bags, coffee beans, coffee pods, coffee capsules, coffee chocolates ,cookies, and confectionery products that can be found.

This provision is to be understood as relevant disclosure under Art. 49 of the Consumer Code.

Applicable law
The Conditions of Sale are governed by Italian law and in particular by Legislative Decree September 6, 2005 no. 206 (so-called Consumer Code), with specific reference to the regulations on distance contracts and by Legislative Decree April 9, 2003 no. 70 on certain aspects concerning trade.

Jurisdiction for the resolution of any dispute will be that provided by the Italian legislation in force at the time of the conclusion of the contract.
